1. Purpose
This document sets out the conditions for taking part in the activities organised by Holística Nature Ecotourism, Training and Wellbeing, S.L. (hereinafter, THE DATA CONTROLLER), including activities such as:
- Ecotourism and geotourism
- Outdoor trails and activities
- Forest bathing
- Yoga and wellbeing
- Face-to-face and online training
Registration for or participation in any of these activities implies the reading, understanding and express acceptance of this Disclaimer and Health Declaration.
2. Nature of the activities and inherent risks
In many cases, the activities on offer take place in natural environments, which implies the existence of inherent risks, amongst others:
- Uneven surfaces, uneven or slippery ground
- Changing weather conditions
- Physical fatigue
- Risks associated with outdoor travel
The participant declares that they are aware of these risks and voluntarily accepts responsibility for their involvement, undertaking to follow the instructions of the staff in charge at all times.
3. Declaration of health and physical condition
The participant declares that:
- They are in suitable physical and mental condition to take part in the activity.
- They do not suffer from any illness, injury or medical condition that would prevent them from taking part in the activity safely, or they have informed the organisers in advance.
- If they have any significant medical condition (heart or respiratory conditions, reduced mobility, pregnancy, psychological disorders, etc.), they have notified the organisers in advance and are taking part at their own risk.
Yoga, wellbeing or eco-psychology activities do not replace medical, psychological or physiotherapy treatments.
4. Participant’s responsibility
The participant undertakes to:
- Act responsibly and prudently whilst carrying out the activity.
- Respect the natural environment and conservation regulations.
- Use the appropriate equipment recommended by the organisation.
- Follow the instructions given by the guide or trainer.
THE DATA CONTROLLER accepts no liability for any damage arising from:
- Reckless or negligent behaviour on the part of the participant.
- Failure to follow the instructions given.
- Withholding relevant information about one’s state of health.
5. Insurance policies taken out
THE DATA CONTROLLER has:
- Civil Liability Insurance, in accordance with current regulations.
- Assistance and rescue insurance, intended for dealing with incidents that may arise during the course of the activities.
These insurance policies do not cover incidents arising from:
- Irresponsible or negligent behaviour on the part of the participant.
- Failure to comply with safety regulations.
- Activities carried out outside the scope of the organised event.
6. Minors
Children will only be permitted to take part where the activity expressly states that they may do so and with written authorisation from the father, mother or legal guardian, who takes responsibility for the child during the activity.
7. Use of images and audiovisual material (optional but recommended)
During the activities, photographs or video recordings may be taken for informational or promotional purposes.
The participant consents to the use of their image, unless they state otherwise in writing before the start of the activity, in accordance with current legislation.
8. Limitation of liability
THE DATA CONTROLLER shall not be liable for indirect damages, financial losses, minor injuries or incidents arising from risks inherent in the activity, provided that it has acted with due diligence and in accordance with the applicable regulations.
Nothing in this document excludes or limits any legal liability that cannot be excluded under applicable law.
9. Express acceptance
Registration, purchase or participation in an activity implies the express acceptance of this Disclaimer and Health Declaration, which will be permanently available on the website www.holisticanature.com.
